\n\n\nCERCLA means the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (Superfund) (Public Law 96-510), as amended by the Superfund Amendments and Reauthorization Act of 1986, 42 U.S.C. 9601 et seq.\n
\nSubset of CERCLA\nBrownfield : A brownfield is defined as, under certain legal exclusions and additions, real property, the expansion, redevelopment, or reuse of which may be complicated by the presence or potential presence of a hazardous substance, pollutant, or contaminant.\n
\nSubset of CERCLA\nUncontrolled Sites: The Assessment & Remediation Branches (I & II) manage uncontrolled sites defined as a site, facility, plant, or location where hazardous substances, pollutants, or contaminants have been released into the environment and, due to existing regulations, there is no Federal program which can handle the problem. The Branches oversee planning and cleanup activities such as environmental assessments, remedial investigations, and feasibility studies performed by responsible parties at contaminated sites. \nThe Uncontrolled Site Evaluation Trust Fund was created by the Mississippi Legislature (Section 17-17-54 of Mississippi Code), which in turn established the Uncontrolled Site Voluntary Evaluation Program which allows accepted parties the opportunity to expedite the evaluation of site information. The Program allows the staff to more effectively prioritize sites according to:\n
\n\u2022actual or potential threat to the public health\n\u2022actual or potential threat to the environment\n\u2022whether the site is currently being considered for economic development\n\u2022whether the site is currently participating in the Uncontrolled Site Voluntary Evaluation Program\n
The company must submit an application to be accepted into the Program by MDEQ and pay all costs associated with MDEQ\u2019s administration and evaluation of the site.
